Some bankruptcy courts allow releases of third-parties in a chapter 11 plan in exceptional circumstances, although other hold that bankruptcy courts have no power to grant releases to anyone other than the debtor. In some cases where third-party releases are allowed, the courts determined that consideration was given in exchange for the releases and that the releases were critical to the reorganization.
